LeO should reintroduce ‘free cases’, says Society

first_imgThe Law Society has called on the Legal Ombudsman to give firms two ‘free cases’ per year, and consider exempting those acting pro bono from paying fees.Previously the ombudsman exempted firms from having to pay fees for the first two complaints it investigates. This was abolished in April 2013. Practitioners currently have to pay £400 per case.In a response to a consultation on the LeO’s draft budget proposals for 2016-17, the Law Society said that the impact of case fees on small practitioners ‘can be considerable’. It wants the two free case fee rule reinstated, and consideration given to exemptions where work is carried out pro bono. It also said the LeO should consider whether the level of case fees should form part of its review on scheme rules.The Society said: ‘We recognise there is a balance between maintaining the quality of decision-making and cost reduction, and we welcome the chair’s commitment to ensuring both. We would like to see the LeO look at ways it could cut costs, for instance by settling complaints at an earlier stage.’ The Law Society welcomed the news that LeO will reduce spending by £500,000 in the next financial year to £11.7m. City firm fined record £500k over solicitor’s links with investment schemes

first_imgThe Solicitors Disciplinary Tribunal today confirmed its largest-ever fine levied against a law firm in England and Wales.The tribunal ordered that US firm Locke Lord, which has an office in London, must pay £500,000 after admitting four allegations of misconduct.The fine relates to a failure to supervise a solicitor from involving himself and using the client account in transactions that bore the hallmarks of dubious financial arrangements or investment schemes.Locke Lord admitted failing to have effective systems and controls in place to spot potential conflicts of interest, and failing to prevent a solicitor from directing or requesting payments in and out of the client account which were not related to an underlying legal service. These allegations are as yet unproven.In a statement, Locke Lord said the matters investigated by the SRA concern the actions of that solicitor and relate only to clients for whom he worked. None of the firm’s other clients were affected by these actions. ‘We regret what has happened, but we are pleased to note that the SRA accepted our position that the firm and its senior officers did not act dishonestly or with conscious impropriety, or turn a blind eye to [the solicitor’s] conduct.’After their departure and in consideration of matters that came to light, steps were taken to review existing practices and procedure. A number of changes and improvements were made.’We remain committed to ensuring that we are at the forefront of best practice, that we uphold the legal profession’s high standards, and that this situation does not arise again.’The tribunal has yet to publish its judgment, but the SRA says this case will send a message to firms to check their monitoring procedures.Executive director David Middleton added: ‘The tribunal is waking up to the importance of deterrence. In an effort to reach out to the community, the Bank is going into schools that are part of their Esiloan product as an appreciation for banking with Kina Bank. Kina Bank manager Esiloan branch Philo Antonette Warakoi last Friday donated 200 T-shirts to the school. “Lae International School has recently come on board our Esiloan product whereby they are offering us business and in return we have to give something to them,” Warakoi said. “It is part of our community obligation to give to the people to make our presence felt in the communities,” she said. Lae International School principal Rosalea Cameron thanked the bank and said the involvement of students with the community is very important to the school. “We are very grateful. Engaging with the community is very important to us and we’re working with the students to understand that they’ve got an obligation to look after the community. “It is important being that we try to raise ethical leaders of Papua New Guinea thus engaging with reputable businesses,” Cameron said. The Bank will be donating another 200 shirts to Lae Secondary School today. Lae Secondary School is not a client to the Bank but the Bank has recognised it its provincial secondary school status to give them something.
